This website (the "Website") is provided to you by 10:10. In these Terms, "us" or "we" or "our" means 10:10. The term "you" refers to the users or viewers of our Website.
These Terms are the terms on which we provide the Website and allow you to make a donation to enable your chosen school (the "School") to purchase a solar energy system. Your donation will be represented by one or more virtual solar squares (each a "Tile") (or an entire panel of Tiles depending on the size of your donation) on the Website. Please read these Terms carefully before using the Website. You should keep a copy of these Terms for future reference. For information on how we will use your personal data, please see our privacy policy. These Terms are only available in the English language.
We may change these Terms from time to time so you should make sure you check the terms regularly to ensure you are familiar with any changes. References to a "Working Day" are to a day which is not a weekend or bank holiday in either England or Wales.
Your use of the Website
You confirm that:
- all information and details provided by you to us (including that provided when you make any donation) are true, accurate and up to date in all respects and at all times. You can update or correct your personal details at any time by contacting us via the details set out at the end of these Terms; and
- you will comply with the restrictions on your use of the Website as set out in these Terms.
- Your use of the Website and its contents grants no rights to you in relation to our intellectual property rights or those of the schools taking part in the Project including, without limitation, copyright trade marks, logos, graphics, photographs, animations, videos and text or the intellectual property of third parties in the Website and its contents.
You may not copy, reproduce, republish, download, post, broadcast, record, transmit, commercially exploit, edit, communicate to the public or distribute in any way the pages or materials on the Website or the computer codes of elements comprising the Website other than for your own personal use. Subject to the above, you may download insubstantial excerpts of this content to your hard disk for the purpose of viewing it provided that no more than one copy of any information is made. Any use other than that permitted under this clause may only be undertaken with our prior express authorisation.
We are happy for you to link to our homepage on any reputable sites but we may ask you to remove them at our discretion if we have any concerns.
You must not use the Website: for any unlawful purpose; in any way that interrupts, damages, impairs or renders the Website less efficient; to transfer files that contain viruses, trojans or other harmful programs; to access or attempt to access the accounts of other users or to penetrate or attempt to penetrate any security measures; to disseminate any content which is defamatory, obscene, or may have the effect of being harassing, threatening or abusive to an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability or otherwise or which is inappropriate for an audience which may include children. If you are a business sponsoring a Tile, it is your responsibility to ensure that you comply with all applicable advertising rules, guidelines and codes of practice. You undertake that any content posted on the Website complies with the Content Code of Conduct.
In relation to content posted by other users you acknowledge that we have limited control over the nature and content of such content. Although we reserve the right to do so, we may not monitor such content in the usual course of business and will not be liable for any such content. If you have a complaint about another user or content posted on the Website please contact us via the details set out at the end of these Terms.
You agree to compensate and defend us fully against any claims or legal proceedings brought against us by any other person as a result of your breach of these Terms.
Sponsoring a Tile
The Website provides you with the opportunity to "Sponsor a Tile" on the Website when you make a donation towards the School's purchase of a solar energy system. For more details on what this entails see the FAQ section of our Website and the Donation Terms and Conditions.
We accept payment of donations via the Website by GoCardless only. Please see the GoCardless payment terms before making a donation. You confirm that the account from which payment is being made is yours. All accounts may be subject to validation checks and authorisation. If your bank refuses to authorise payment we will not accept your donation and we are not obliged to inform you of the reason for the refusal.
We are not responsible for your bank charging you as a result of our processing of your payment in accordance with your donation.
If you want to remove your details from a Tile at any time, just let us know. This won't mean that you are entitled to any refund of your donation.
Access to the Website
We reserve the right to suspend, restrict or terminate your access to our Website and/or remove any content posted by you at any time without notice if we have reasonable grounds to believe you have breached any of these Terms and/or the Donation Terms and Conditions. This shall not limit our right to take any other action against you that we consider appropriate to defend our rights or those of any other person.
Our Legal Obligations and Limits on our Liability
We accept liability for death or personal injury caused by our negligence or that of our employees and agents. We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents.
You have certain rights under the law. These include that we will provide any services to a reasonable standard and within a reasonable time. Nothing in these Terms is intended to affect these statutory rights. For more information about your statutory rights contact your local Citizens Advice Bureau or Trading Standards Office.
We are not responsible for: losses not caused by our breach; indirect losses which are a side effect of the main loss or damage and which are not reasonably foreseeable by you and us at the time of entering into this Agreement, for example loss of profits or loss of opportunity; failure to provide the Website and service or to meet any of our obligations under this Agreement where such failure is due to Events Beyond our Control.
"Events Beyond Our Control" means any cause beyond our reasonable control which prevents Us from providing the Service or fulfilling any of our other obligations under this Agreement and includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident, terrorist activity and acts of God.
Our total liability to you for any loss or damage arising in connection with you use of the Website and these Terms is limited to the value of your donation.
General
If you breach these Terms and we take no action against you, we will still be entitled to use our rights and remedies in any other situation where you breach these Terms.
If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other provisions shall continue to apply.
We will do our best to resolve any disputes over this Agreement. If you wish to take court proceedings against us you must do so within the United Kingdom. Relevant United Kingdom law will apply.

Privacy Policy
This policy (together with our terms of use and any other documents referred to on it) sets out the basis on which 10:10 (“us” or “we” or “our”) collect and process any information provided by you to us from which you can be personally identified. 10:10 is the organisation responsible for running the Solar Schools project (the "Project").
We are data controllers of any such personal information and we are registered for the purposes of the Data Protection Act 1998 (the “Act”) under the following registration number: Z1891365. What information do we collect?
We may collect and process the following data about you:
Information that you provide by filling in any forms on our website at www.solarschools.org.uk (the “Website”).
Information that you provide to us or one of our Project partners or third party suppliers when you donate money to the school and/or supply or post material for inclusion on the Website.
We may also ask you for information if you report a problem with our Website.
If you contact us, we may keep a record of that correspondence.
We may also collect information about your computer, including where available your IP address, operating system and browser type, for system administration and to report aggregate information to our advertisers. This is statistical data about our users’ browsing actions and patterns, and does not identify any individual.
Please note that when you make a donation via the Website you will be directed to GoCardless, our third party payment service provider who will process your payment. Payments are made subject to the GoCardless payment terms and conditions and privacy policy. GoCardless may provide both 10:10 and your school information about your donation, including your name, email address and the amount of your donation. Neither 10:10 nor the school will receive your bank account or credit card information from GoCardless. Please note that we do not accept any responsibility or liability for these terms and conditions or policies and, in particular, how GoCardless may collect and process your information. Please therefore check these before making your donation.
What do we do with your information?
We use information held about you to:
Carry out our obligations arising from any contracts entered into between you and us (for example, the receipt of donations from you); and
Ensure that content from our Website is presented in the most effective manner for you and for your computer.
We may also use your information to:
Notify you about changes to our service;
Enable your school to provide you with updates regarding your school's progress and participation in the Project; and
Contact you regarding the Project and provide you with information about other carbon cutting activities and initiatives carried out by us.

Where will your information be stored and how will it be protected?
Our suppliers may transfer and store your information at a destination outside the European Economic Area (“EEA”) and your information may also be processed by staff operating outside the EEA. We will take all steps reasonably necessary to ensure that your information is treated securely and in accordance with this privacy policy.
All information you provide to us is stored on secure servers. Where we have given you (or where you have chosen) a unique access link to enable you to amend your tile on the Website or your account details, you are responsible for keeping this confidential. We ask you not to share this access link with anyone.
Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your information, We cannot guarantee the security of data transmitted to the Website; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access
Will your information ever be disclosed?
We may disclose your personal information to third parties in certain circumstances as follows:
To the school to which you have provided a donation, who may contact you directly.
To any suppliers (for example to payment providers) in order to process any donations.
If we are acquired by a third party, your information may be one of the transferred assets.
If we are under a duty to disclose your information in order to comply with any legal obligation; in order to enforce or apply our terms of use or to protect our rights. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.
What rights do you have?
You have the right to ask us not to process your personal data for marketing purposes. We will usually inform you (before collecting your data) if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes. You can exercise your right to prevent such processing by un-checking certain boxes on the Website when we collect your data. Our Website may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. You have the right to request a copy of the information that we hold about you. If you would like a copy of some or all of such information, please contact us. We may make a small charge for this. You may ask us to correct or remove information you think is inaccurate by contacting us.
