Donation Terms and Conditions
This website (the "Website") is provided to you by 10:10. In these Terms, "us" or "we" or "our" means 10:10. The term "you" refers to the users or viewers of our Website.
We (the "School") are participating in the Solar Schools project (the "Project") with 10:10 which enables you to make a donation to enable us to purchase a solar energy system. Your donation will be represented by one or more virtual solar squares (each a "Tile") (or an entire panel of Tiles depending on the size of your donation and subject to space availability (for the avoidance of doubt larger donations may be distributed across a number of individual virtual solar Tiles and may not be presented as a complete panel)) on the website www.solarschools.org.uk (the "Website"). Please read these Donation Terms carefully before donating and retain a copy for future reference.
The Project will run from 1st October 2015 until 31st July 2016.
If you choose to donate you acknowledge and agree that: (a) unless you tell us in writing not to, we may post your name, any picture you provide to us and message (a "Posting") on one or more Tiles on the Website; (b) all information and details provided by you to us are true, accurate and up to date and that any Posting will comply with our Content Code of Conduct; (c) the position of your Tile(s) may change on the Website, e.g. as new Tiles are added; (d) you won't be entitled to a refund of any donation at any time; (e) we or 10:10 may elect not to publish your Posting on the website and/or remove your Posting from the Website at any time in accordance with clause 6 below, and (f) your donation does not grant you any rights of ownership over any part of any solar energy system installed by us (or any alternative use in accordance with clause 5) or right to any future income or financial saving made by us as a result.
You can ask us in writing to amend or remove your name and message from the Website at any time (but please remember that no refund of any donation made by you will be given).
In the event that we either (a) do not raise the amount required to purchase a solar energy system; or (b) are unable to achieve any applicable planning consents required from a local authority for the installation of solar panels; (c) are advised that the installation of solar panels at our premises is not possible or is inadvisable for structural reasons; or (d) are unable to proceed for any other reason, we shall use all monies donated as part of another energy-saving or green initiative as we may decide in consultation with 10:10. If we raise funds in excess of the target amount for the purchase of a solar energy system, we shall either purchase additional solar energy installations or spend the amounts raised on an alternative energy-saving or green initiative.
We may (but are not obliged to) review the content of any Posting prior to it being published on the Website. We reserve the right not to publish any Posting that we determine in our absolute discretion does not comply with the 10:10 Content Code of Conduct. We and 10:10 reserve the right to review and remove content on the Website in whole or in part and at any time, at our discretion and without any obligation to do so, regardless of whether or not it is, in the opinion of anyone else, against the 10:10 Content Code of Conduct, these Donation Terms and/or the 10:10 Website terms and Conditions.
We accept liability for death or personal injury caused by our negligence or that of our employees and agents. We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents.
You have certain rights under the law, including that we will provide any services to a reasonable standard and within a reasonable time. Nothing in these Donation Terms is intended to affect these statutory rights. For more information contact your local Citizens Advice Bureau or Trading Standards Office.
We are not responsible for: (a) losses not caused by our breach; (b) indirect losses which are a side effect of the main loss or damage and which are not reasonably foreseeable by you and us at the time of entering into this Agreement, for example loss of profits or loss of opportunity; or (c) failure to provide the Website or to meet any of our obligations under this Agreement where such failure is due to Events Beyond our Control. "Events Beyond Our Control" means any cause beyond our reasonable control which prevents us from participating in the Project or fulfilling any of our other obligations under these Donation Terms and includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident, terrorist activity and acts of God.
Our total liability to you for any loss or damage arising in connection with these Donation Terms is limited to the value of your donation.
We will do our best to resolve any disputes over these Donation Terms. If you wish to take court proceedings against us you must do so within the United Kingdom. Relevant United Kingdom law will apply.
10:10 is entitled to rely on and enforce these Donation Terms in its own right and for its own benefit.
